WHY DO WE NEED YOUR EXPRESS CONSENT TO USE THEM?
  • Judgment of the Grand Chamber of the Court of Justice of the European Union, of October 1, 2019 and Guide on the use of AEPD cookies, July 2020.

The judgment of the Grand Chamber of the Court of Justice of the European Union, of October 1, 2019, must be interpreted in the sense that consent is not validly given when the storage of information through cookies, or access to information already stored on the user’s computer of an internet website, is authorized by means of a box marked by default, which the user must uncheck in case who wants to refuse its use. Thus, authorization must be based on explicit consent through a Checkbox ofacceptance explicit, a check of rejection by the user and another by more information of the exposed cookies. This interpretation, moreover, cannot vary depending on whether or not the information stored or consulted on the user’s terminal of a website consists of personal data.

The Grand Chamber of the Court of Justice of the European Union also provides in this judgment that the information that the service provider must provide to the user of an internet website must include the time in which the cookies will remain assets and the possibility that third parties can access the information they store. This requirement is established by the modified version of Directive 2009/136, which modifies article 5, section 3, of Directive 2002/58/EU, and by the AEPD Guide, of July 2020.

In relation to the possibility that the user can reject the use of cookies, it should be taken into account that if he rejects them or deletes the web browsing cookies, we will not be able to maintain his preferences, some characteristics of the pages they will not be operational, we will not be able to offer you personalized services and every time you browse our website we will have to request your authorization for the use of cookies again. If, even so, you decide to modify the configuration of your access to the web page, you should know that it is possible to delete cookies or prevent this information from being recorded on your computer at any time by modifying the configuration parameters of your browser :

These browsers are subject to updates or modifications, so we cannot guarantee that they will fully match your browser version. You may also be using another browser not covered in these links such as Konqueror, Arora, Flock, etc. To avoid these mismatches, you can access directly from the options of your browser which is usually found in the Options menu, in the “Privacy” section.
