WHY DO WE NEED YOUR EXPRESS CONSENT TO USE THEM?

The judgment of the Grand Chamber of the Court of Justice of the European Union, of October 1, 2019, must be interpreted in the sense that consent is not validly given when the storage of information through cookies, or access to information already stored on the user’s computer of an internet website, is authorized by means of a box marked by default, which the user must uncheck in case who wants to refuse its use. The Grand Chamber of the Court of Justice of the European Union also provides in this judgment that the information that the service provider must provide to the user of an internet website must include the time in which the cookies will remain assets and the possibility that third parties can access the information they store. This requirement is established by the modified version of Directive 2009/136, which modifies article 5, section 3, of Directive 2002/58/EU, and by the AEPD Guide, of July 2020.
